Recalling Warrants

The process for warrant recall in San Diego varies, depending on both the type of warrant and the court where the warrant was issued. In some cases, your attorney for bench warrant recall assistance will be able to request the recall on your behalf without the need for you to appear in court. That’s not the case for felony or certain misdemeanor warrants, like those issued in domestic violence or child abuse cases. In those situations, you will need to appear in court with your attorney.

If your warrant was issued by the South Bay Branch of the San Diego Court, your lawyer will have to appear in person in the early morning hours to request a recall of warrant hearing. The hearing can usually be scheduled the same day although there is no guarantee to address it this quickly.

In the North County Branch, an attorney requesting a warrant recall must appear in person, ask the judge to calendar the matter (typically for a future date depending on the Court’s availability which can be two to three weeks out), and then provide relevant details to the District Attorney.

The Superior Court Central Division and East County Division both require the attorney requesting a warrant recall on behalf of a client to appear in court and set a hearing date that is at least three days later. Both the attorney and client need to attend that scheduled court date.

Note that almost all cases involving felony charges will require the client to appear alongside with their attorney. Recalling a warrant is not an immediate process because of having to schedule a hearing for a Judge to address the matter.
